Thokchom Raja, 27, was sentenced to 7 years imprisonment under section 4 of POCSO Act for by special judge POCSO Imphal East, Gaiphulshillu Golmei POCSO Imphal East, today for sexually assaulting a minor victim on February 9 in 2016.
The sentence was announced after the hearing of the case before the court against the convict, Raja alias Bijoy, son of Tangba of Toubul Mayai leikai. He was convicted by the same court on March 13 2019.
The court heard the submission of Special PP for the state and Legal Aid counsel who appeared on defence of the convict.
Special PP submitted that Thokchom Raja has been convicted under section 4 of POCSO Act and prays to punish the convict to maximum degree as the convict knew that the offence committed by him is against the law.
On the other hand, Defense counsel submitted to punish the convict in lesser degree by pointing out the allegation except the present has been the only one made so far, and the convict is not a habitual offender and had no prior connection to any criminal cases.
Defense counsel also prayed for setting aside the period of convict spent in judicial custody from the sentence. The court considering the facts and hearing the both parties, ordered the convict to undergo simple imprisonment of 7 years from today and the period which the convict has been in custody be set off from the sentence period.
Court also directed to the Director of Social Welfare department to release a sum of 50 Thousand Rupee as compensation to the victim on being approached by the victim or her family members on behalf of the victim.
