Imphal/ Guwahati, August 1: In a first for Manipur since independence, a 21-year-old man was awarded death penalty by a district court on Tuesday in a 2015 rape and murder case of a 4-year-old girl that had shaken the state.
The convict, R David was convicted under section 6 of POCSO Act and section 302 of IPC and Special judge, POCSO, A Noutuneshwari Devi, announced the verdict a day after the conviction.
The police report says that the victim was raped and murdered in a stable in the vicinity of Maram Kavanam Village in December 2015. The Mao police station registered a suo-motu case and arrested the convict, R David two days later.
The police report also says that the villagers knew about the crime and attempts were made to sweep the case under the carpet by compensating the parents of the victim. The body of the deceased girl was exhumed and a post-mortem was conducted in the presence of a magistrate after the case was registered. The reports concluded sexual assault and death from strangulation.
21 witnesses were examined during the course of the hearing and charges against David were framed on July 5, 2018.
The court also recommended awarding of a compensation of Rs 25 lakh to the mother of the victim as per NALSA.
The Judge later said that there is no mitigating factor to deter in other alternative punishment and was of the view that maximum punishment should be awarded and it should be an eye opener for the society at large in order to prevent such brutal and heinous crime in the society, say reports.~Time8
