IMPHAL | Aug 28: Special judge, ND and PS (FTC), Manipur convicted two persons who were arrested for selling heroin at a school campus, under section 21 and 29, ND and PS Act, 1985. The court has fixed sentence hearing on September 5.

The duo has been identified as Lianpu Simte, 35, son of N. Khampu Simte of Tengnuam village, Churachandpur district and Biaklian Paite,27, son of Jomkhothang Paite of Bungmual village, Churachandpur district.

It was mentioned that the special trail case has been transferred from Special Judge, ND and PS under direction of Manipur High Court on May 4. After FIR was registered under section 21/29 ND and PS Act, 1985 the IO of the case submitted charge sheet with due investigation before the court, on December 15, 2003. The charge was framed against the duo on November 28, 2018 in a separate sheet.

The case incident happened on September 8, 2001 as the two persons were trying to sell a large quantity of No.4 heroin powder inside the school campus of St. Piter School, Thangmeiband Sanakeithel. After receiving complaints, SP, NAB along with police team of BA-PS rushed to the place. On reaching at the school gate, two persons were found loitering in a very suspicious manner. On seeing the police, they ran inside the school and the police chased them. They were detained inside a class room and a polythene bag was seized from them.

Two packets containing 200gms each of heroine powder and the third packet contained 100gms of heroin powder was found containing in the polythene bag.

Upon interrogation, Biaklian Paite disclosed that he had brought the heroin powder from Churachandpur district and kept the same in the custody of Lianpu Simte for selling them. Lianpu Simte also disposed that Biaklian Paite had brought and kept the heroin powder in his custody with insurance of giving Rs. 10,000 as commission after selling it out. The two accused were arrested along with the heroin powder from the school campus.

After the case was transferred to the special judge ND and PS (FTC), the materials were analysed and took seven prosecution witnesses. The submission of special PP and defence counsel was also heard. The court after all necessary trail convicted the two accused as it was proved by the prosecution that the 500 gms of heroin powder seized from the unauthorised possession of the accused Biaklian Paite was of commercial quantity.

And also, Lianpu Paite as a the staff of the school was convicted for supporting the illegal selling of drugs at the school as he had committed the offence punishable under section 21/29 ND and PS Act, 1985.

The court fixed September 5 for sentence hearing till that they were handed over to Manipur Central Jail, Sajiwa and to produce the two accuse before the court on September 5.
